Upon payment of the deposit, the tenant agrees to the conditions below:
General Rental Conditions Casa La Valle Verde
The following general conditions apply to the conclusion of a temporary rental agreement between owner and tenant of the holiday home, the temporary rental agreement hereinafter also referred to as: rental agreement.
“Landlord” shall mean Casa La Valle Verde, landlord of the holiday home to be rented.
“Manager” shall mean the contact person in Italy appointed by the owner or by Casa La Valle Verde on behalf of the owner.
“Invoice amount” shall mean the rent increased by the costs of the final cleaning and the deposit.
Article 1: Conclusion of rental agreement
Reserving a holiday home may take place by telephone, WhatsApp, or via email.
For booking via internet, the rental agreement is concluded under the suspensive condition of receipt by email of a confirmation from Casa La Valle Verde.
Booking is definitive once the tenant has transferred the deposit and this has been confirmed by the tenant.
The aforementioned reservations are final and binding, i.e. in the case of cancellation, cancellation costs are due.
Article 2: Obligations of landlord
Landlord makes the holiday home available to the tenant under the conditions included in the rental contract.
Landlord ensures that the holiday home is made available to the tenant in a well-maintained condition.
Landlord furthermore guarantees that the locally customary or contractually agreed utilities are connected and that the tenant can make use of them.
Article 3: Obligations of tenant
In the event that a pet is allowed after consultation, the tenant must ensure that it has proof of vaccinations. Additional costs must also be paid for this, and the tenant must ensure that the house and garden are left tidy.
The tenant must take out his own travel insurance and cancellation insurance.
The holiday home may not be occupied by more than 7 persons, except by way of exception and only after permission of Casa La Valle Verde. The number 7 may not be exceeded. In case of exceeding without prior permission, the rental agreement is considered dissolved by operation of law and access to the holiday home is refused. The tenant remains liable in such case for the full rent, by way of compensation and/or remuneration (rent) for the enjoyed use. The tenant has no claim to refund of already paid amounts.
The landlord respects the natural environment of the house and ensures that it is quiet from 23:00 until 7:00.
The landlord will himself ensure waste separation and disposal according to local practices in the designated containers at several places in the area.
Article 5: Changes and cancellations by tenant
(our advice! Always take out cancellation insurance! This often must be done within 8 days after booking!)
For each change, up to a maximum of 16 weeks before arrival, in a confirmed booking, Casa La Valle Verde charges an amount of €100.00.
Every cancellation must be made known to Casa La Valle Verde by email.
In case of cancellation of the rental agreement by the tenant, the following cancellation costs will be charged:
- For cancellation more than 16 weeks before the start of the booked stay, an amount of 50% of the total rent is due.
- For cancellation from 16 weeks before the start of the booked stay, the total rent is due.
In case of premature termination of the stay, the full rental amount remains due.
Article 6: Termination or amendment by Casa La Valle Verde
Casa La Valle Verde may only terminate or amend the rental agreement in the following cases:
- in case of force majeure such as, among others, war, strike, natural disaster, extraordinary weather conditions, fire, bankruptcy, unannounced sale and/or taking into use of the holiday home by the owner, etc.
- due to compelling circumstances. “Compelling circumstances” shall mean circumstances of such a nature that Casa La Valle Verde cannot reasonably be required to remain bound.
In both cases Casa La Valle Verde shall refund the full invoice amount to the tenant as soon as possible. Any other damages or consequences of termination or amendment shall not be compensated by Casa La Valle Verde.
Article 7: Payment conditions
Within 7 days after the reservation date, 35% of the total rental amount and the reservation costs must be paid by transfer to a bank account designated by Casa La Valle Verde.
The remainder, cleaning costs and deposit must be fully paid no later than 8 weeks before the start of the rental period to the designated bank account of Casa La Valle Verde.
For reservation less than 6 weeks before the start of the rental period, the entire invoice amount must be paid immediately after reservation confirmation by Casa La Valle Verde.
The deposit will be refunded in the week after leaving the house.
Rental prices include VAT.
Rental prices include consumption of gas, water and electricity for the air conditioning.
Rental prices include bed linen and bath linen.
Rental prices exclude final cleaning costs (€150).
Article 8: Availability of the holiday home
The holiday home is rented for a week arrangement from Saturday to Saturday. On the day of arrival the house can be occupied after 15:00 and on the day of departure it must be vacated and delivered free before 12:00.
Article 12: Pets
One pet is allowed after consultation. Pets must be well-trained and not damage or soil the house, furniture, or garden.
Article 13: Smoking
It is not permitted to smoke in the holiday home.
Article 14: Inventory
The holiday home is fully furnished for 7 persons including linen (sheets, pillowcases).
Article 15: Final cleaning
After completion of the stay, the rented holiday home must be delivered by the tenant neatly and “broom clean.”
Crockery with accessories must be returned clean in the cupboards, the coffee machine clean, the beds stripped, no garbage left behind. Refrigerator and heating switched off, and keys of the house handed in to the manager.
Furniture that has been moved must be returned to its original place.
Upon arrival the tenant must himself check whether the items mentioned in the inventory list are present. If something is damaged or missing, the tenant must report this within 24 hours after arrival to the manager. The manager will do his utmost to repair or replace the item. Upon departure the tenant may report any damage via a form. The damage will be charged at cost price.
Article 16: Damage
Damage to the inventory caused by you will be charged to you. The same applies to damage to the house. Note that you must be insured for this via your liability insurance or by taking out travel and baggage insurance.
Article 17: Liability
Casa La Valle Verde accepts no liability for:
a. theft, loss or damage, of any kind, during or as a result of a stay in the rented holiday home;
b. malfunction or deactivation of technical equipment in the homes, temporary outage or malfunctions in and around the holiday home of water and/or energy supply, unannounced roadworks and/or construction works around the holiday home;
c. failure to perform the rental agreement in whole or in part in case of force majeure. This also includes negligence by service provider(s) and/or manager engaged by the owner, on whom Casa La Valle Verde depends;
d. obvious errors or mistakes on its website or other communications;
e. any damage to the car. It is indicated that Casa La Valle Verde is located on a so-called “white road” (2 minutes by car), which is a paved road (municipally maintained good gravel road), which in principle is passable, but not suitable for very lowered cars.
As regards accidents in or around the house, Casa La Valle Verde, the manager or the owner cannot be held liable.
The tenant is jointly and severally liable for all loss and/or damage to the rented property and its inventory, regardless of whether this is the result of acts or omissions of the tenant or of third parties present in the rented property with the tenant’s consent.
In case of incorrect use or incorrect leaving behind of the rented home, additional costs will be charged to the tenant.
In compiling the website and the information with each offered home, Casa La Valle Verde has taken great care regarding the reliability and correctness of the data. Nevertheless, Casa La Valle Verde cannot guarantee the correctness and completeness of this information and therefore cannot be held liable for damage that may arise as a result of inaccuracies or incompleteness.
Casa La Valle Verde is in no way liable towards the tenant for the execution of the rental agreement or any related obligation. Casa La Valle Verde is therefore not liable for acts and/or omissions of the involved landlord(s) nor for the correctness of the information provided by these landlord(s). Casa La Valle Verde bears no responsibility for photos, brochures and other information material, insofar as these have been provided to it by third parties.
