General Rental Conditions of Casa La Valle Verde
The following general terms and conditions apply to the rental agreement. A temporary rental agreement between the owner and tenant of the holiday home, the temporary rental agreement hereinafter also referred to as the rental agreement.
“Landlord” refers to the Casa La Valle Verde landlord of the holiday home to be rented.
“Manager” refers to the contact person in Italy designated by the owner or by Casa La Valle Verde on behalf of the owner.
“Invoice amount” refers to the rent plus the costs of final cleaning and the security deposit.
Article 1: Establishment of the Rental Agreement
Reservations for a holiday home can be made by phone, WhatsApp, or email.
When booking online, the rental agreement is concluded subject to the condition precedent of receipt of an email confirmation from Casa La Valle Verde.
The booking is final once the tenant has paid a deposit and this has been confirmed by the tenant.
The aforementioned reservations are final and binding, meaning that cancellation fees are due in the event of cancellation.
Article 2: Landlord Obligations
The landlord will make the holiday home available to the tenant under the conditions stated in the rental agreement.
The landlord will ensure that the holiday home is made available to the tenant in a well-maintained condition.
The landlord also guarantees that the usual on-site or contractually agreed utilities are connected and that the tenant can use them.
Article 3: Tenant Obligations
If a pet is permitted after consultation, the tenant must ensure that it has proof of vaccinations. Additional costs must also be paid for this and ensure that the house and garden are left tidy. The tenant is responsible for arranging travel and cancellation insurance.
The holiday home may be occupied by no more than 7 people, subject to exceptions and with the permission of Casa La Valle Verde. The number of 7 may not be exceeded. If the number of people is exceeded without prior permission, the rental agreement will be considered automatically terminated and access to the holiday home will be denied. In such a case, the tenant remains liable for the full rental amount, as compensation or reimbursement (rent) for the enjoyment of the rental property. The tenant is not entitled to any refund of amounts already paid.
The landlord respects the natural surroundings of the house and ensures that it is quiet from 11:00 PM to 7:00 AM.
The landlord will arrange for waste separation and disposal in accordance with local customs in the designated containers at several locations in the area.
Article 5: Changes and cancellations by the tenant
(our advice: always take out cancellation insurance! This must often be done within 8 days of booking!)
For any changes to a confirmed booking, up to 16 weeks before arrival, Casa La Valle Verde will charge a fee of €100.00.
Every cancellation must be notified to Casa La Valle Verde by email.
In the event of cancellation of the rental agreement by the tenant, the following cancellation fees will be charged. If you cancel more than 16 weeks before the start of your booked stay, you will be charged 50% of the total rental amount.
If you cancel 16 weeks or less before the start of your booked stay, you will be charged the full rental amount.
If you terminate your stay early, you will still be charged the full rental amount.
Article 6: Termination or Modification by Casa La Valle Verde
Casa La Valle Verde may only terminate or modify the rental agreement in the following cases:
in the event of force majeure, such as war, strikes, natural disasters, exceptional weather conditions, fire, bankruptcy, unannounced sale and/or occupation of the holiday home by the owner, etc.
due to significant circumstances. Significant circumstances are defined as circumstances of such a nature that Casa La Valle Verde cannot be expected to continue to be bound.
In both cases, Casa La Valle Verde will refund the full invoice amount to the tenant as soon as possible. Any other damages or consequences of termination or modification will not be reimbursed by Casa La Valle Verde.
Article 7: Payment Terms
Within 7 days of the reservation date, 35% of the total rental amount and the reservation costs must be paid by bank transfer to a bank account specified by Casa La Valle Verde.
The remaining balance, cleaning costs, and deposit must be paid in full into the bank account provided by Casa La Valle Verde no later than 8 weeks before the start of the rental period.
For reservations made less than 6 weeks before the start of the rental period, the entire invoice amount must be paid immediately upon receipt of confirmation from Casa La Valle Verde.
The deposit will be refunded the week after departure.
Rental prices include VAT.
Rental prices include gas, water, and electricity for the air conditioning.
Rental prices include bed linen, towels, and towels.
Rental prices exclude final cleaning costs (€150).
Article 8: Availability of the holiday home
For a weekly package, the holiday home is rented from Saturday to Saturday. The house can be occupied after 3:00 PM on the day of arrival and must be vacated by 12:00 PM on the day of departure. Article 12: Pets
One pet is permitted, after consultation. Pets must be well-behaved and not damage or soil the house, furnishings, or garden.
Article 13: Smoking
Smoking is not permitted in the holiday home.
Article 14: Inventory
The holiday home is fully furnished for 7 people, including linens (sheets, pillowcases).
Article 15: Final Cleaning
The rented holiday home must be left tidy and “swept clean” by the tenant at the end of the stay.
Dishware and accessories must be returned clean to the cupboards, the coffee maker clean, the beds made, and no trash left. The refrigerator and heating must be turned off, and the house keys must be returned to the manager.
Moved furniture must be returned to its original location.
Upon arrival, the tenant is responsible for checking whether the items listed on the inventory form are present. If anything is damaged or missing, the tenant must report this to the manager within 24 hours of arrival. The manager will do their utmost to repair or replace the item. Upon departure, the tenant can report any damage using a form. The damage will be charged at cost price.
Article 16: Damage
You will be charged for any damage to the inventory caused by you. The same applies to damage to the property. Please ensure you are insured for this through your liability insurance or by taking out travel and baggage insurance.
Article 17: Liability
Casa La Valle Verde accepts no liability for:
a. theft, loss, or damage of any nature during or as a result of a stay in the rented holiday home;
b. the malfunctioning or inoperability of technical equipment in the homes, temporary outages or disruptions in and around the holiday home of water and/or energy management, unannounced roadworks and/or construction work around the holiday home;
c. the failure to perform the rental agreement in full or in part due to force majeure. This also includes negligence on the part of the service provider(s) and/or manager engaged by the owner, on whom Casa La Valle Verde relies;
d. obvious errors or mistakes on its website or other notifications;
e. any damage to the car. It is indicated that Casa La Valle Verde is located on a so-called “white road” (a two-minute drive). This is a paved road (a good gravel road maintained by the municipality), which is generally passable, but not suitable for very low-slung cars.
Casa La Valle Verde, the manager, or the owner cannot be held liable for any accidents in or around the property.
The tenant is solely liable for all loss and/or damage to the rented property and its inventory, regardless of whether this is the result of the actions or omissions of the tenant or third parties present in the property with the tenant’s permission.
In the event of improper use or leaving the rented property in an improper condition, the tenant will be charged additional costs.
When compiling this website and the information for each property offered, Casa La Valle Verde has taken great care to ensure the reliability and accuracy of the information. Nevertheless, Casa La Valle Verde cannot guarantee the accuracy or completeness of this information and therefore cannot be held liable for any damage that may arise as a result of inaccuracies or omissions.
Casa La Valle Verde is in no way liable to the tenant for the performance of the rental agreement or any related obligations. Therefore, Casa La Valle Verde is not liable for the actions and/or omissions of the landlord(s) involved, nor for the accuracy of the information provided by these landlord(s). Casa La Valle Verde is not responsible for photos, brochures, or other information materials provided by third parties.
